Terms of Service
These Terms of Service ("Terms") govern your access to and use of MyCasa ("the Service"), operated by Charles Al Soufi, trading as MyCasa, as an independent founder based in Geneva, Switzerland. By creating an account or using the Service, you agree to be bound by these Terms.
1. Description of Service
MyCasa provides software tools to assist users in researching, planning, and tracking property purchases in Portugal. The Service includes calculators, journey tracking, document management, and a directory of professionals. MyCasa is an information and productivity tool, not a licensed legal, financial, or property advisory service.
2. Not Professional Advice
MyCasa does not provide legal, tax, financial, or property advice. All content, calculators, and information provided through the Service are for informational and educational purposes only. Tax rates and legal requirements change; always verify current rates with Portuguese tax authorities (Autoridade Tributária) or a qualified professional before making financial decisions.
MyCasa is not a licensed intermediário de crédito, advogado, solicitador, or mediador imobiliário. Use of the professionals directory does not constitute a referral or endorsement by MyCasa.
3. Account Registration
You must provide a valid email address to create an account. You are responsible for maintaining the security of your account. You must be at least 18 years old to use the Service. You may not create an account on behalf of another person without their consent.
4. Subscription and Billing
Free plan features are available at no cost. The Buyer Pass is a one-time €79 payment that unlocks full access for 6 months; it does not auto-renew. Existing Buyer Pass holders may purchase a 3-month extension for €39. Buyer Pass payments are sold through Stripe Managed Payments / Link, which acts as merchant of record and handles payment processing, indirect tax, invoices, receipts, transaction support, refunds and disputes for the purchase. Prices may change with notice. MyCasa generally does not offer refunds after 14 days unless required by applicable law. Stripe/Link's Managed Payments terms also apply: Link support may issue refunds in additional circumstances for up to 60 days after purchase, including without MyCasa's prior approval if a transaction-support escalation is not answered within 48 hours. If you need a refund or billing help, use the billing contact form or the transaction-support options supplied by Link.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of Portuguese or EU law
- Attempt to reverse-engineer, scrape, or systematically extract data from the Service
- Use automated means to access the Service beyond what the API permits
- Upload malicious files, viruses, or harmful content
- Misrepresent your identity or impersonate any person or entity
- Use the Service to facilitate money laundering or tax evasion
6. User Content
You retain ownership of data you upload to the Service (documents, notes, purchase data). By uploading content, you grant MyCasa a limited licence to store and process it solely to provide the Service to you. MyCasa does not sell, share, or use your personal data for advertising. 7. Third-Party Services
The Service may link to or integrate with third-party services (Stripe/Link for managed payments, Resend for email, etc.). Stripe/Link is the merchant of record for Buyer Pass transactions and applies its own transaction terms. MyCasa is not responsible for the content, practices, or availability of other third-party services. The professionals directory lists independently operating professionals; MyCasa does not guarantee their services, qualifications, or conduct.
8. Disclaimers and Limitation of Liability
The Service is provided "as is" without warranties of any kind. MyCasa does not warrant that tax rates, legal information, or calculator results are accurate, complete, or current. MyCasa is not liable for any financial loss, missed deadlines, or legal consequences arising from reliance on information provided by the Service. To the maximum extent permitted by applicable law, MyCasa's total liability for any claim arising from use of the Service is limited to the fees paid by you in the 12 months preceding the claim.
9. Termination
MyCasa reserves the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time via account settings. Upon termination, your data will be deleted within 30 days, subject to legal retention obligations.
10. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by email and in-app notification with at least 14 days' notice. Continued use after the effective date constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by Portuguese law. Disputes shall be subject to the exclusive jurisdiction of the courts of Portugal.
